1. Agreement to Terms

By accessing or using OneClick3D ("the Service," "we," "our," or "us"), you agree to be bound by these Terms of Service ("Terms"). If you disagree with any part of these terms, you may not access the Service.

These Terms apply to all visitors, users, and others who access or use the Service.

2. Description of Service

OneClick3D is an AI-powered platform that converts images into 3D models. Our Service allows you to:

• Upload images (1-5 images per generation)
• Generate production-ready 3D models using AI technology
• Download 3D models in various formats (GLB, USDZ, FBX, OBJ, STL)
• Access your generation history
• Manage your account and credits

The Service uses third-party AI technology (fal.ai) to generate 3D models from your uploaded images.

3. Account Registration

To use certain features of the Service, you must register for an account. You may register using:

• Email and password (with email verification)
• Google OAuth authentication

You agree to:

• Provide accurate, current, and complete information
• Maintain and update your information
• Keep your password secure and confidential
• Notify us immediately of any unauthorized use of your account
• Be responsible for all activities that occur under your account

You must be at least 13 years old to use the Service. By using the Service, you represent that you meet this age requirement.

4. Credits and Payment System

4.1 Credit-Based System

OneClick3D operates on a pay-as-you-go credit system:

• Each 3D model generation costs between 10-20 credits depending on the model selected (Rodin v2: 10 credits, Meshy v6: 20 credits)
• Credits are purchased through Stripe in various packages
• Credits are non-transferable and non-refundable except as specified in Section 5

4.2 Credit Packages

We offer the following credit packages (subject to change):

• Starter: 60 credits (6 generations) - $9.99
• Basic: 150 credits (15 generations) - $19.99
• Plus: 450 credits (45 generations) - $49.99
• Pro: 1,000 credits (100 generations) - $99.99
• Ultimate: 3,000 credits (300 generations) - $249.99

4.3 Credit Expiration

• Credits expire one (1) year after purchase date
• You will receive reminders before your credits expire
• Expired credits cannot be recovered or refunded
• We recommend using credits within the expiration period

4.4 Payment Processing

• All payments are processed securely through Stripe
• We do not store your credit card information
• Prices are in USD unless otherwise stated
• All sales are final unless otherwise specified

4.5 Credit Deduction and Refund

• Credits are deducted immediately when you initiate a 3D generation
• If generation fails due to technical errors, credits are automatically refunded
• Credits are not refunded for successful generations, even if you're unsatisfied with results
• We reserve the right to refund credits at our discretion in exceptional circumstances

5. Refund Policy

5.1 No Refunds

All credit purchases are final and non-refundable. We do not offer refunds for any unused portion of your credits. All sales are final.

Why? Credits are digital goods delivered instantly. We recommend starting with our Starter package (60 credits for $9.99) to test the service before investing in larger credit packages. This allows you to experience the quality and understand the nature of AI-generated 3D models.

5.2 Automatic Credit Refunds (Technical Failures Only)

• Credits are automatically refunded if a generation fails due to technical issues
• Refunds are processed immediately to your credit balance
• No action is required from you to receive automatic refunds
• Failed generations are marked as "FAILED" in your history

5.3 Exceptional Circumstances

Refunds may only be considered in rare exceptional cases such as:

• Technical error or duplicate charge by our payment processor
• Unauthorized transaction (with proof)
• Service completely unavailable for an extended period after purchase

5.4 No Refunds for Quality or Dissatisfaction

We do not provide refunds based on dissatisfaction with generated 3D model quality. By purchasing credits, you acknowledge that:

• You reviewed example generations on our homepage before purchasing
• AI generation results can vary based on input quality and complexity
• Example generations are displayed on our homepage for reference
• You understand the nature of AI-generated 3D models

6. File Storage and Downloads

• Generated 3D models and textures are stored for a minimum of 7 days
• After 7 days, files may be deleted at any time without notice
• We strongly recommend downloading your files immediately after generation
• We are not responsible for deleted files after the 7-day minimum period
• Storage is provided by our third-party provider (fal.ai) and subject to their policies
• You may access your generation history, but download links may expire

7. Acceptable Use Policy

You agree NOT to use the Service to:

• Upload illegal, harmful, or inappropriate content
• Upload images depicting minors or violate privacy rights
• Generate content that infringes intellectual property rights
• Upload images you don't have rights to use
• Create 3D models for illegal purposes
• Abuse, harass, or harm others
• Circumvent technical limitations or security features
• Attempt to reverse engineer or copy our technology
• Use automated systems (bots) to access the Service
• Resell or redistribute credits or generated models without permission
• Overload or interfere with the Service's operation

Violation of this policy may result in immediate termination of your account and forfeiture of all credits without refund.

8. Intellectual Property Rights

8.1 Your Content

• You retain ownership of images you upload
• You grant us a license to process your images for 3D generation
• You represent that you have rights to upload and use the images

8.2 Generated Content

• You own the 3D models generated from your uploaded images
• You may use generated models for personal or commercial purposes
• We do not claim ownership of your generated models
• You are responsible for ensuring your use complies with applicable laws

8.3 Our Service

• The Service, including its design, code, and features, is owned by OneClick3D
• Our trademarks, logos, and branding are protected
• You may not copy, modify, or create derivative works of our Service

9. Service Availability and Limitations

• We strive for 99% uptime but do not guarantee uninterrupted access
• The Service may be unavailable during maintenance or updates
• We do not guarantee specific generation times (typically 2-5 minutes)
• AI generation quality may vary based on input images and settings
• We rely on third-party services (fal.ai) which may affect availability
• We reserve the right to modify or discontinue features at any time

10. Disclaimers and Limitation of Liability

10.1 Service "As Is"

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.

10.2 No Guarantee of Results

We do not guarantee that:

• Generated 3D models will meet your specific requirements
• The Service will be error-free or uninterrupted
• Files will be stored beyond the 7-day minimum period
• Results will match your expectations or examples shown

10.3 Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, ONECLICK3D SHALL NOT BE LIABLE FOR:

• Indirect, incidental, special, consequential, or punitive damages
• Loss of profits, data, or business opportunities
• Damages resulting from use or inability to use the Service
• Damages resulting from deleted or lost files
• Damages caused by third-party services (fal.ai, Stripe, etc.)

OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID FOR CREDITS IN THE PAST 12 MONTHS OR $100, WHICHEVER IS LESS.

11. Indemnification

You agree to indemnify, defend, and hold harmless OneClick3D, its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including attorney fees) arising from:

• Your use of the Service
• Your violation of these Terms
• Your violation of any third-party rights, including intellectual property rights
• Your uploaded content or generated models

12. Account Termination

12.1 Termination by You

• You may delete your account at any time
• Unused credits will be forfeited upon account deletion
• Downloaded files remain yours after account termination

12.2 Termination by Us

We may suspend or terminate your account if:

• You violate these Terms of Service
• You engage in fraudulent or illegal activity
• Your account is inactive for an extended period
• Required by law or legal process

Upon termination for violation, you forfeit all credits without refund.

13. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify users of material changes by:

• Updating the "Last updated" date
• Posting a notice on the Service
• Sending an email notification (for significant changes)

Your continued use of the Service after changes constitutes acceptance of the new Terms.

14. Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of the jurisdiction where OneClick3D operates, without regard to its conflict of law provisions.

Any disputes arising from these Terms or your use of the Service shall be resolved through:

• Good faith negotiations
• Binding arbitration if negotiations fail
• Small claims court (if eligible)

You waive the right to participate in class action lawsuits or class-wide arbitration.

15. Miscellaneous

15.1 Entire Agreement

These Terms, along with our Privacy Policy and Refund Policy, constitute the entire agreement between you and OneClick3D.

15.2 Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions will remain in full effect.

15.3 No Waiver

Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights.

15.4 Assignment

You may not assign or transfer these Terms without our consent. We may assign our rights and obligations without restriction.
